Welcome to Air Pro LLC dba Chimney Doctors. These Terms of Service govern your use of our website www.chimneydoctorsmn.com and the chimney, fireplace, and related home services we provide. By accessing our Site, requesting an estimate, or scheduling Services, you agree to these Terms. If you do not agree, please do not use the Site or our Services.
- Services
We provide chimney sweeping, inspection, repair, masonry, relining, fireplace installation, and related home services. The specific scope of any work will be described in the written estimate, work order, or invoice provided to you for that job. Those job-specific documents, together with these Terms, form the agreement between us for that work. - Estimates and Quotes
Estimates are based on the conditions observed at the time of inspection. Hidden, concealed, or pre-existing conditions that are not reasonably visible at the time of the estimate (including but not limited to internal flue damage, water damage, structural issues, or code deficiencies) may not be reflected in the original price. If additional work is required, we will notify you and obtain your approval before proceeding, except in the case of an immediate safety hazard. Estimates are valid for 30 days unless otherwise stated. - Scheduling, Cancellations, and Rescheduling
Appointments are scheduled in advance. If you need to cancel or reschedule, please contact us at least 24 hours before your appointment. We reserve the right to reschedule due to weather, safety conditions, or circumstances beyond our control. - Property Access and Customer Responsibilities
You agree to provide safe and reasonable access to the work area, including the chimney, fireplace, roof, and surrounding areas. You are responsible for securing pets, clearing the work area of personal belongings, and disclosing any known hazards or conditions on the property. We are not responsible for delays or inability to complete work caused by inaccessible work areas or undisclosed conditions. - Payment Terms
Payment is due UPON COMPLETION / AS STATED ON THE INVOICE. We accept all credit cards, cash, checks and financing. Deposits will be stated in your estimate. Past-due balances may accrue interest or late fees as permitted by law. If collection becomes necessary, you agree to pay reasonable costs of collection, including attorney’s fees, to the extent permitted by Minnesota law. - Warranties
We warrant that our workmanship will be performed in a professional manner consistent with industry standards. Specific warranty terms for a given job, if any, will be stated in your written estimate or invoice. Manufacturer warranties on installed products are governed by the manufacturer and passed through to you where applicable. This warranty does not cover: damage resulting from normal wear and tear, misuse, improper use of the fireplace or appliance, failure to perform recommended maintenance, acts of nature, pre-existing conditions, or work performed by anyone other than the Company. - Disclaimers and Limitation of Liability
Chimney and fireplace systems are complex, and inspections are limited to conditions that are reasonably accessible and visible at the time of service. We do not guarantee the discovery of every defect, and we are not liable for latent or concealed conditions that could not be reasonably detected. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND SITE ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY STATED HEREIN, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. Nothing in these Terms limits liability that cannot be limited under applicable law. - Safety Recommendations
Following an inspection, we may recommend that a chimney or fireplace not be used until certain repairs are completed. You acknowledge that using a system against our recommendation is at your own risk, and the Company is not responsible for any resulting damage or injury. - Site Use and Intellectual Property
All content on the Site, including text, logos, graphics, and images, is owned by or licensed to the Company and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content without permission. You agree to use the Site only for lawful purposes. - Privacy
Your use of the Site and Services is also governed by our Privacy Policy, available at https://chimneydoctorsmn.com/privacy-policy/, which is incorporated into these Terms by reference. - Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted to the Site with an updated “Last updated” date. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms. - Governing Law and Disputes
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles.
